Returns
If you receive a surfboard or surfboard accessory (e.g., leash, fins, etc.) that is damaged or defective, you can return it within 30 days of your date of purchase, provided that the product is in new and unused condition. No refunds will be offered on surfboards and/or surfboard accessories that are not in new and unused condition. Returns are refunded in the method of original payment, and there will be no refunds for shipping costs.
Please email us at support@fundaysurf.com to initiate the return and receive Return Authorization (RA#) number. Please allow up to two weeks for the processing of your return. Your issuing bank may take an additional billing cycle to apply the credit to your card.
Warranty
Fun Day Surf surfboards carry a 30-day Limited Warranty for manufacturer and material defects.
Limited Warranty
All Fun Day Surf surfboards are warrantied to be free of manufacturing and materials defects for thirty (30) days from the date of purchase, subject to the terms and conditions herein. All claims of any manufacturing or materials defect must be made within thirty (30) days directly to Fun Day Surf or to the retail store where the board was purchased, together with proof of purchase, using the procedure set forth below.
If it is determined by Fun Day Surf that a manufacturing defect is present, Fun Day Surf will either repair the surfboard or replace the surfboard with a similar product at its sole discretion. There will be no monetary refunds or exchanges for any product.
Any Fun Day Surf surfboard used for commercial purposes, such as rentals, surf schools and camps, are not warrantied for any period of time. Also, the installation of any third-party parts and/or accessories, such as fins, grips and/or mounts voids the limited warranty. Drilling or cutting into, and/or affixing objects to, the Fun Day Surf surfboards also voids the limited warranty. Also, Fun Day Surf cannot warranty against damage to, or breakage of, a surfboard caused or incurred during its use, even if such damage falls within the thirty (30) day limited warranty period. Damage to any surfboard resulting from wear and tear, misuse, exposure to the sun, heat or elements, or simply caused by the demands of the board when in use, including but not limited to boards that are wrecked, snapped, punctured, scraped, broken, crushed, compressed, dented, and fins or straps that are broken or damaged, or any other damage or breakage of any kind that is not caused by a manufacturing or materials defect, is not covered at any time. Due to nature of materials used in the construction of soft surfboards, there will be some water absorption, which is normal and not a defect. This water typically drains after each use. Finally, any surfboard that has not been cared for and handled in accordance with our Care & Handling Guide is not covered by this limited warranty.
Warranty Procedure
If your surfboard suffers from a manufacturing or workmanship defect and is under warranty, please contact us at support@fundaysurf.com. Please include detailed explanation of the issue and clear digital photos of entire top side of board, entire bottom side of board and of any specific area(s) of concern.
Fun Day Surf reserves the right to make final determination of the warranty status in its sole discretion. If a defect exists, Fun Day Surf will choose, in its sole discretion, whether to (1) repair the surfboard at no charge, (2) exchange the surfboard with a surfboard that is functionally equivalent to the original surfboard, or (3) refund the purchase price of the surfboard. When a surfboard is exchanged, any replacement surfboard becomes the customer’s property and the replaced surfboard becomes Fun Day Surf’s property. When a refund is given, the product becomes Fun Day Surf’s property. Qualified surfboards must be returned to Fun Day Surf at the customer’s expense, and accompanied by the original receipt for the sale of the surfboard, clearly showing the date of purchase.
Safety Precautions
Fun Day Surf surfboards are not intended to be used as a floatation, safety or life-saving device. Do not use Fun Day Surf surfboards if you are not a good swimmer or in any waters in which you are unable to safely swim, including where dangerous rip tides or currents may be present, and do not paddle or surf alone. Adult supervision and caution are strongly recommended by any persons under the age of eighteen (18) years. Always use caution when using a Fun Day Surf surfboard by inspecting for rocks, reefs and other dangerous areas nearby, and maintain a safe distance from other surfers, boats and vessels while using a Fun Day Surf surfboard. Fun Day Surf surfboards are not intended to be used (i) for sledding or sliding on any surfaces other than water, or (ii) as a pool floatation device. Keep product away from open flames.
The use of a life jacket when operating or riding a Fun Day Surf surfboard is recommended in all circumstances and it is required by law in many circumstances.
Warning: Risk of Personal Injury or Death; User Assumes All Risk
Surfing is an inherently dangerous activity and accidents may occur. Risks include, but are not limited to, the risk of drowning and the risk of collision. Use of a Fun Day Surf surfboard requires a special degree of skill and knowledge, and you should not use this product without sufficient skill and knowledge. The user of the surfboard and/or their heirs, executors or assignees agree to release and hold harmless Fun Day Surf, Inc. and any employees, subsidiaries, related companies, distributors and/or agents of Fun Day Surf, Inc., including but not limited to retailers of the Fun Day Surf surfboards, from any liability, claims, causes of action and demands of any kind arising from or out of the use of the Fun Day Surf surfboards where such use results in bodily injury, including serious injury, loss of limbs and/or death, or property damage. The user is exclusively responsible for his or her own safety, the risks associated with the Fun Day Surf surfboard, and any personal injury to, or death of, the user or any third party as a result of the use of the Fun Day Surf surfboard.
Full Terms and Conditions of the Limited Warranty
This limited warranty is extended only to the customer who originally purchased the surfboard and does not extend to any subsequent owner or other transferee of the surfboard regardless of whether the surfboard is transferred during the term of the warranty.
THIS LIMITED WARRANTY AND THE REMEDY SET FORTH ABOVE UNDER THE HEADING “WARRANTY PROCEDURE” ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. FUN DAY SURF, INC. LIMITS THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE DURATION OF THIS LIMITED WARRANTY. NO FUN DAY SURF, INC. RESELLER, AGENT OR EMPLOYEE IS AUTHORIZED TO MAKE ANY MODIFICATION, EXTENSION, OR ADDITION TO THIS LIMITED WARRANTY, NOR ARE THERE ANY WARRANTIES CREATED BY COURSE OF DEALING, COURSE OF PERFORMANCE OR TRADE USAGE.
Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
UNDER NO CIRCUMSTANCES SHALL FUN DAY SURF, INC. BE LIABLE TO ANY PERSON (INCLUDING, WITHOUT LIMITATION, ANY USER OR ANY THIRD PARTY) FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR OTHER DAMAGES IN CONNECTION WITH, ARISING UNDER OR RELATED TO ANY SURFBOARD (WHETHER UNDER THEORY OF CONTRACT, TORT, INDEMNITY, PRODUCT LIABILITY, NEGLIGENCE, OR OTHERWISE) INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM PERSONAL INJURY OR DEATH. FUN DAY SURF, INC.’S LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE LESSER OF (A) DAMAGES SUFFERED AS A DIRECT RESULT OF A PRODUCT DEFECT OR (B) THE ACTUAL AMOUNT PAID FOR ANY DEFECTIVE SURFBOARD. THE FOREGOING LIMITATIONS ON LIABILITY SHALL BE ENFORCED TO THE MAXIMUM EXTENT ALLOWABLE BY LAW EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion of incidental and/or consequential damages may not apply to you.
This warranty shall be governed by and construed in accordance with the laws of California, excluding that State’s choice-of-law principles, and all claims relating to or arising out of the purchase of the surfboard whether in contract, tort or otherwise, shall likewise be governed by the laws of California, excluding that State’s choice-of-law principles. Any suit brought by a customer against Fun Day Surf, Inc. for claims arising out of this warranty shall be brought in the United States District Court for the Central District of California, or in the event that court lacks jurisdiction to hear the claim, in the Orange County Superior Court.
Disclaimer of Any Warranty for Non-Surfboard Products
ALL NON-SURFBOARD PRODUCTS FROM FUN DAY SURF, INC. ARE SOLD AS IS, AND FUN DAY SURF, INC. MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO SUCH GOODS, INCLUDING NO WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE. FUN DAY SURF, INC. MAKES NO REPRESENTATION THAT ITS PRODUCTS ARE OF ANY PARTICULAR STANDARD OR QUALITY.
Care & Handling
Please adhere to the following care and handling guidelines:
Excessive Heat Warning
When exposed to high temperatures and/or direct sunlight for extended periods of time beyond ordinary use, the surfboards may bubble and/or fade in color. Surfboards are required to be stored in a cool, dry place out of direct sunlight or heat. Do not leave in a car for extended periods of time.
Any damage caused by excessive sunlight or heat exposure is NOT covered under our limited warranty.
Avoid Impacts
Impacts may damage your surfboard and any damage caused by impacts is NOT covered under our limited warranty.
General Care
After every use, please rinse your board with fresh water to remove dirt, sand and salt residue. Then, wipe it down with a clean cloth or towel and store away from direct sunlight, in a cool, dry location. Do not use solvents or cleaners on your surfboard.
Due to nature of materials used in the construction of soft surfboards, there will be some water absorption, which is normal and not a defect. This water typically drains after each use.
Wax your surfboard as you would any other surfboard. No basecoat needed.
When riding your surfboard, we recommend using a surf leash and staying away from sharp reefs and/or rocky shorelines as the surfboard may be compromised if impact occurs. Do not use your surfboard in questionable conditions, shore-break, or extremely shallow conditions as this will void your warranty and may cause bodily harm.
Your surfboard is not meant for use as a lifesaving device or meant for use as a rental board/surf school board.
Transporting
When strapping the surfboard onto vehicle roof racks, do not cinch the straps too tight, as it may crease the rails. Use a board bag as much as possible when mounting to your vehicle.
